Rent indexation in Brussels: registration, EPB and correction factors

Brussels has the strictest conditions of the three regions. Before you calculate a single figure, two formalities must be met:

If either is missing, indexation is not allowed for as long as that remains the case. The tenant may then reclaim an indexation that was charged anyway.

The standard calculation

After that, the usual formula applies: basic rent × new index ÷ starting index, using the health index. The new index is that of the month before the anniversary of the entry into force; the starting index is that of the month before the signing of the contract.

The Brussels energy freeze and the correction factors

Between 14 October 2022 and 13 October 2023, indexation in Brussels was limited based on the EPB label: label E could index at 50%, labels F and G not at all. For contracts that entered into force before 14 October 2022 with label E, F or G, that restriction carries on permanently through a correction factor (ordinance of 13 October 2023):

Which years "A" and "B" are depends on when your contract's anniversary fell during the freeze year: if it fell between 14 October and 31 December 2022, you use the index figures of 2021 and 2022; if it fell between 1 January and 13 October 2023, those of 2022 and 2023 — in each case the month before the anniversary. The factor remains in force until you can present a better EPB certificate (A through D).
